2. Collection and storage of personal data and the nature and purpose of their use

a) When visiting the website
When you visit our website www.barth1873.de, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in what is called a log file. The following information is collected without any action on your part and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the retrieved file,
  • website from which the access is made (referrer URL),
  • the browser used and, if applicable, the operating system of your computer and the name of your access provider.

We process the aforementioned data for the following purposes:

  • ensuring comfortable use of our website,

The legal basis for data processing is Art. 6 (1) sentence 1 f GDPR. Our legitimate interest follows on from the data collection purposes listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you as an individual. We also use cookies and analytic services when you visit our website. b) When using our contact form
If you have any questions, you can contact us using the form provided on the website. A valid email address is required so we know who sent the enquiry and can respond to it. Further information can be provided voluntarily.
Data processing for the purpose of contacting us is carried out in accordance with Art. 6 (1) sentence 1 a GDPR on the basis of your voluntarily granted consent.
The personal data we collect for the use of the contact form will be automatically deleted after your enquiry has been processed.

3. Forwarding of data

Your personal data will not be transferred to third parties for purposes other than those listed below.
We only forward your personal data to third parties if:
You have expressly consented to it according to Art. 6 (1) sentence 1 a GDPR,
according to Art. 6 (1) sentence 1 f GDPR, disclosure is necessary for the establishment, exercise or defence of legal claims and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data,
in the event that the disclosure is legally required under Art. 6 (1) sentence 1 c GDPR, and
this is legally permissible, and is required for the processing of contractual relationships with you as defined in Art. 6 (1) sentence 1 b GDPR.

4. Cookies

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware.
Information is stored in the cookie that relates to the specific end device used. However, this does not mean that we will directly become aware of your identity.

5. Analysis tools

a) Tracking tools
The tracking measures listed below and used by us are carried out on the basis of Art. 6 (1) sentence 1 f GDPR. With the tracking measures used, we want to ensure a needs-based design and the continuous optimisation of our website. Furthermore, we use tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising what we offer you. Google Analytics
We use Google Analytics, a web analysis service of Google Inc (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter referred to as “Google”) for the purpose of designing and continuously optimising our pages to meet your needs. In this context, pseudonymised user profiles are created and cookies (see section 4) are used. The information generated by cookies about your use of this website, such as

  • host name of the accessing computer (IP address),

Matomo
We use the open-source software Matomo to analyse and statistically evaluate the use of the website. Cookies are used for this purpose (see section 4). The information generated by the cookie about website usage is transmitted to our servers and summarised in pseudonymous usage profiles. The information is used to analyse the use of the website and to allow our website to be designed based on users’ needs. The information will not be passed on to third parties.
Under no circumstances will the IP address be associated with other data relating to the user. The IP addresses are anonymised so that an identification is not possible (IP masking).

6. Rights of data subjects

  • according to Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information on its details;
  • according to Art. 16 GDPR to immediately demand the correction of incorrect or incomplete personal data stored by us;
  • according to Art. 17 GDPR to demand the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
  • according to Art. 18 GDPR to demand the restriction of the processing of your personal data if you contest the accuracy of the data, the processing is unlawful but you oppose the erasure of the data, and we no longer need the data but you require it for the establishment, exercise or defence of legal claims or you have objected to processing pursuant to Art. 21 GDPR;
  • according to Art. 20 GDPR to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller;
  • according to Art. 7 (3) GDPR to revoke your consent once given to us at any time. As a result, we shall not continue the data processing that was based on this consent in the future, and
  • according to Art. 77 GDPR to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our office.

7. Right of objection
If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 (1) sentence 1 f GDPR, you have the right, pursuant to Art. 21 GDPR to object to the processing of your personal data if there are grounds relating to your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right to object, which we will implement without you needing to specify a particular situation.

8. Data security
We use the widespread SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser when you visit our website. As a rule, this involves 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can recognise whether an individual page of our website is transmitted in encrypted form by the display of the closed key or lock symbol in the lower status bar of your browser.
We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
